2. What Tintaki is
Tintaki is a web application that allows a marketing agency to:
- Store the brand identity of each of its clients (logo, colours, typefaces, tone).
- Create posts for social networks, with optional help from third-party artificial intelligence tools for texts and images.
- Send each post to the client via a link that opens on a mobile phone, so that the client can approve it or request changes.
- Publish approved posts on the client's Instagram professional accounts and Facebook Pages, or schedule them in the agency's Metricool account, on the chosen date and time.
3. Who can use it
3.1. Tintaki is intended exclusively for professionals: companies, self-employed persons and agencies that use it for their business activity. On signing up, the person subscribing declares that they are acting as a professional and not as a consumer.
3.2. The person accepting these terms declares that they have sufficient authority to bind the company on whose behalf they subscribe. In these terms, that company is "the Customer".
3.3. The Customer may invite members of its team ("Users"). It is responsible for what its Users do in Tintaki and for keeping their passwords secret.
3.4. The Customer's clients (the brands for which the agency works, "Brands") have no contract with Tintaki. They only access the approval link and the connection of their social networks, at the Customer's invitation.
4. Sign-up, trial and plans
4.1. Signing up requires a valid email address, the company's tax details and acceptance of these terms and of the data processing agreement.
4.2. trial period, if any pending
4.3. The plans, their limits (number of brands, users, posts, AI generations) and their prices are those shown on the pricing page at the time of subscribing. Prices do not include VAT, which is added as applicable.
5. Payments
5.1. Payments are processed through Stripe (Stripe Payments Europe, Limited, Ireland). Tintaki does not store full card details.
5.2. The subscription is monthly or annual and renews automatically at the end of each period, unless the Customer cancels it beforehand from its dashboard.
5.3. If a charge fails, Stripe will retry it. If payment is still outstanding after 14 days, the account will become read-only and scheduled posts will not be published until the situation is resolved. Tintaki will notify the Customer by email before this happens.
5.4. Price changes: these will be notified at least 30 days in advance and will apply from the next renewal. If the Customer does not agree, it may cancel before that date.
5.5. Refunds: periods already paid are not refunded, except in the event of a serious service failure attributable to Tintaki or as required by law.
5.6. Invoices are issued electronically and are available in the dashboard.
6. Connection with Instagram, Facebook and Metricool
6.1. To publish, the Brand (or the person at the agency who has access to its business portfolio in Meta) connects its accounts using Meta's official login and chooses which Instagram account and which Facebook Page it shares with Tintaki. Tintaki never asks for or stores Instagram or Facebook passwords.
6.2. The Customer warrants that it has the Brand's authorisation to connect its accounts and to publish on them on its behalf.
6.3. Dependence on Meta. Publishing works thanks to the interfaces offered by Meta Platforms. Meta may change, restrict or withdraw them, impose publishing limits (for example, a maximum number of posts per day per account), suspend accounts or revoke Tintaki's access. Tintaki is not liable for publishing failures caused by Meta, by the Brand disconnecting the account, or by accounts that do not meet Meta's requirements (for example, personal rather than professional accounts). In such cases Tintaki will notify the Customer as soon as it detects the failure so that it can publish manually.
6.4. The use of Instagram and Facebook is also governed by Meta's terms and policies, which the Customer and the Brand must comply with.
6.5. The Brand or the Customer may disconnect the accounts at any time from Tintaki or from their portfolio settings in Meta.
6.6. Metricool. If the Customer connects its own Metricool account with its access token, Tintaki schedules in it the posts that the Customer instructs, and Metricool publishes them. The token is stored encrypted and is deleted on disconnection. The relationship between the Customer and Metricool is governed by the contract between them, and Tintaki is not liable for failures, limits or changes in the Metricool service.
7. Approval by the Brand
7.1. The approval link is personal. Whoever receives it can view the post, approve it or request changes. The Customer decides who to send it to.
7.2. Tintaki keeps a record of each approval (who, when, from which device and IP, and the exact version approved) as evidence for the Customer. Tintaki only publishes the version that was approved; if it is modified afterwards, it requires approval again.
7.3. The Customer may configure posts without prior approval. In that case, responsibility for publishing without the Brand's approval lies solely with the Customer, and Tintaki records this in the activity log.
8. Artificial intelligence
8.1. Tintaki offers tools that generate texts and images using third-party artificial intelligence providers (currently, Anthropic for texts and image provider pending for images). The up-to-date list is in the data processing agreement.
8.2. AI-generated content is a proposal. It may contain errors, inaccurate data, similarities with third-party works or trade marks, or inappropriate results. The Customer must review it before sending it for approval and is responsible for what is finally published.
8.3. Labelling. When an image or video has been generated or substantially modified with AI, Tintaki will by default label it as AI-generated content when publishing it on Instagram (using the tool Meta provides for this purpose) and will inform the Customer. The Customer must not remove that label where the content could lead people to believe that it shows real persons, places or events. This responds to the transparency obligations of Article 50 of Regulation (EU) 2024/1689 on Artificial Intelligence, applicable from 2 August 2026.
8.4. The Customer must not use the AI tools to generate content that is illegal or misleading, that impersonates real persons, that reproduces protected works without permission, or that infringes the usage policies of the AI providers.
8.5. Tintaki does not use the Customer's content to train AI models and has chosen providers that, under their commercial terms, do not do so either with data sent via the API.
8.6. Tintaki does not warrant that AI-generated content is original or that it can be protected by intellectual property rights.
9. Content and intellectual property
9.1. The content belongs to the Customer or its Brands. Logos, images, texts and other material that the Customer uploads or creates in Tintaki ("Content") remain theirs or their Brands'.
9.2. The Customer grants Tintaki a limited, non-exclusive and royalty-free licence to store, process, transform (for example, convert formats or adapt sizes), send to AI providers when the Customer so requests, and publish the Content on the connected networks and services, solely to provide the service and for the duration of the contract.
9.3. The Customer warrants that it holds the necessary rights over the Content (including photos of people, music, typefaces and trade marks) and will hold Tintaki harmless against third-party claims relating to that Content.
9.4. The Tintaki application, its code, its design and its brand belong to service owner pending or its licensors. The Customer acquires no rights over them beyond the use of the service.
9.5. Third-party software. Parts of Tintaki are based on FigCraft, by the ArtCraft team, distributed under the MIT or Apache 2.0 licence, at your option, with the notice "Copyright (c) 2026 ArtCraft Team and the FigCraft contributors". Tintaki is not affiliated with or endorsed by ArtCraft, and does not use its name or logos as a brand. The full texts of these licences and those of the other open-source components will be published on the licences page.
10. Acceptable use
The Customer undertakes not to use Tintaki to:
- publish content that is illegal, defamatory or discriminatory, that incites hatred or violence, or that infringes third-party rights;
- advertise in a misleading manner or in breach of advertising regulations, including those of regulated sectors (alcohol, gambling, health, financial);
- send spam, automate fake interactions or circumvent Meta's limits;
- attempt to access accounts, data or parts of the system that it is not entitled to;
- resell the service without written authorisation.
Tintaki may remove content or suspend an account that breaches these rules, notifying the Customer of the reason unless the law or urgency prevents it.
Notices of illegal content. Anyone may report illegal content hosted on Tintaki by writing to notices email pending with the URL or a description of the content and the reason. The point of contact for authorities and recipients of the service is the same email address, in Spanish or English.
11. Availability and support
11.1. Tintaki strives to be available continuously, but does not guarantee uninterrupted operation. Scheduled downtime will be announced in advance whenever possible.
11.2. If a scheduled post is not published due to a Tintaki failure, the Customer will receive a notice in the dashboard and by email.
11.3. Support by email at support email pending, on working days, from 9:00 to 18:00 (Spanish mainland time).
12. Personal data
12.1. The data of the people who use Tintaki as the Customer's Users is processed by Tintaki as controller, in accordance with the privacy policy.
12.2. The data that the Customer enters about its Brands and about the contact persons of those Brands is processed by Tintaki on behalf of the Customer, as processor (or sub-processor), in accordance with the data processing agreement, which forms part of these terms.
12.3. The data is hosted on servers located in the European Union (Germany).
13. Liability
13.1. Tintaki is responsible for providing the service with due professional diligence.
13.2. Tintaki is not liable for: the content published by the Customer or approved by the Brand; the commercial results of the posts; the failures, changes or decisions of Meta, Metricool or the AI providers; or indirect damage such as loss of profit or loss of clients.
13.3. Except in cases of wilful misconduct or gross negligence, Tintaki's total liability to the Customer is limited to the amount paid by the Customer in the 12 months prior to the event giving rise to it.
14. Term, cancellation and data on termination
14.1. The contract lasts as long as the subscription and renews with it.
14.2. The Customer may cancel at any time from its dashboard. Cancellation takes effect at the end of the period already paid.
14.3. Tintaki may terminate the contract with 30 days' notice, or immediately if the Customer seriously breaches these terms (for example, non-payment or illegal use).
14.4. On termination: the Meta and Metricool accounts are disconnected and their tokens are deleted immediately. The Customer has 30 days to download its Content. After that period, it is permanently deleted, and from backups within a further 30 days at most. Only data that the law requires to be kept, such as invoices, is retained.
15. Changes to these terms
Tintaki may amend these terms. Changes affecting important rights or obligations will be notified by email and in the dashboard at least 30 days in advance. If the Customer does not agree, it may cancel before they take effect at no additional cost.
16. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of city pending, expressly waiving any other jurisdiction, unless the law provides otherwise.
